(TargetLiberty.org) – On Friday, the Supreme Court sided with the Biden administration, temporarily pausing a decision from a lower court that would restrict access to the abortion pill mifepristone.
In a brief order, the justices stated that they would be putting a hold on a ruling from a Texas federal judge, but that this is only a temporary decision. Justices Clarence Thomas and Samuel Alito, two of the conservative justices in the court, have stated that they would have denied the request to have the ruling stopped.
In a statement, President Biden noted that as a result of the recent temporary ruling, mifepristone would remain available and approved. He added that they would continue to stand behind the evidence from the FDA that backed the agency’s approval of the drug and that the Biden administration would continue to “defend FDA’s independent, expert authority to review, approve, and regulate a wide range of prescription drugs.”
Biden proceeded to call for the public to vote for more lawmakers who would be pro-choice so that Congress can “pass a law restoring the protections of Roe v Wade,” Biden said.
Alito claimed in dissent that his position was not reflected in any of the views regarding the FDA’s mifepristone actions.
On April 7, U.S. District Judge Matthew Kacsmaryk suspended the Food and Drug Administration’s 23-year-old approval of mifepristone, claiming that the approval process had been rushed and thus, an unsafe drug was allowed to enter the market. The 5th U.S. Circuit Court of Appeals last week paused this ruling, allowing the FDA’s approval of mifepristone to continue.
