High Court Makes Bombshell Ruling On Abortion Rights

(TargetLiberty.org) – On Friday, the Iowa Supreme Court ruled that the state’s abortion ban is constitutional. This decision overturned one of the lower courts which had placed a temporary injunction on the law.

The ruling came only a day after the first presidential debate between President Joe Biden and former President Donald Trump, where Trump argued that it should be up to individual states to rule on abortion law. 

In a 4-3 ruling, where all justices have been appointed by Republican governors, the court argued that the law had been constitutional. This reverses the Polk County district court’s temporary injunction from last year. During that time the court had allowed the different organizations, including Planned Parenthood to proceed with their litigations against the abortion ban. . 

The Iowa abortion ban starts after a fetal heartbeat has been detected, which is around the sixth week of pregnancy. This is similar to the “heartbeat laws” that have been established in South Carolina, Georgia, and Florida. The bans have been put in place after the 2022 decision of the Supreme Court to overturn Roe v. Wade which provided federal protection for abortions. The Iowa law includes exceptions for incest, unsurvivable fetal abnormalities, rape, or the need to save the mother’s life. 

Republican Iowa Attorney General Brenna Bird in a press release argued that the decision of the state’s Supreme Court made it clear that Iowa stood for life and that she was grateful for this law that would protect the unborn in the state.
