(TargetLiberty.org) – Judge Tanya Chutkan who is presiding over the federal election interference case has provided former President Donald Trump with a lifeline after blocking the requests of the Department of Justice to have Trump be sent to jail over having violated the gag order.

On Sunday Chutkan had reinstated the gag order against Donald Trump. However, in the footnote of her opinion, she stated that the request by the Justice Department prosecutors to have in her order conditions for Trump’s release was denied. As she wrote the court has concluded that the Order was not necessary at this time.

Previously Chutkan had removed the temporary hold on the gag order that had been placed in order for Trump to appeal it. As she argued the right to a fair trial did not only relate to Trump but also to the public and the government.

The order had first been issued by Chutkan after special counsel Jack Smith had brought forward concerns about Trump potentially attempting to attack prosecutors and intimidate witnesses through the public comments he was making. The order was originally placed but had been paused temporarily on October 20 as Trump’s team sought to get the ordered appeal. Trump’s legal team had further argued that the wording of the gag order was confusing.

Michael McAuliffe, the former federal prosecutor and elected state attorney, stated according to Newsweek that Chutkan was being very careful with the opinion because of the scrutiny that the case has resulted in.
