(TargetLiberty.org) – John Allen, the Sheriff of Bernalillo County has stated during a press conference that New Mexico Governor Michelle Lujan Grisham’s (D) “public health order” that has banned open and concealed carry within certain areas of the state is “unconstitutional.” While Allen had originally stood beside her during the policy rollout, on Monday he stated that the order was unconstitutional and that it would not have an effect on gun violence. He further stated that they were not going to be enforcing the order.

As he pointed out they were protecting the Second Amendment, but there was still a lot of violence in the community. As he pointed out his standards were going to remain high and he would not back down on what he believed to be right.

The emergency order was first issued by Grisham on Friday and suspends the right to carry firearms in Bernalillo County and Albuquerque for a minimum of 30 days. The order has been in response to the latest fatal shootings of three children, the latest of which occurred earlier last week when an 11-year-old boy had been shot while leaving a minor league baseball stadium.

The governor has stated that she expects that there will be legal challenges to the order. In order to issue the order she classified it as a public health order, noting that the limitation would not affect licensed security guards and law enforcement officers.

Allen claimed that he had pushed against the order but that Grisham had insisted on it.
