Red State Urges Supreme Court To Stop Biden

(TargetLiberty.org) – On Tuesday, a group of GOP-led states called for the Supreme Court to halt the efforts of the Biden administration to reduce planet-warming emissions for power plants. The petition has been signed by 25 states who are claiming that the Biden rule should be blocked as the case moves through the lower court. Originally a lower court had denied that request. 

The states have claimed that they are most likely to be successful in their case, but that it is going to be harmed if the rule goes into effect while there is still ongoing litigation against it. In the filing, it is noted that the requirements of the rule are just a way of essentially forcing coal plants out of business and that this is something that there have not been any congressional authority permits on.

The states proceeded to argue that the rule in question could not stand. 

The rule specifically states that both existing coal plants and newer gas plants will be required to put technology in place that is going to reduce 90 percent of their carbon emissions. The rule is likely going to move away from coal plants as many companies intend on shutting down their plants rather than looking at the ways they can meet these requirements. 

The Supreme Court previously ruled in 2022 that the Environment Protection Agency (EPA) cannot explicitly state that there should be a move from one power source to another, however, there is nothing blocking the agency from requiring a cut to their emissions.
