Lawyers Call Mayorkas Unimpeachable?

(TargetLiberty.org) – Top lawyers from the Department of Homeland Security (DHS) have been pushing for House lawmakers to stop the “illegitimate, invalid, and dangerous” impeachment attempts against Secretary Alejandro Mayorkas.

On Tuesday, the letter that blasts the Republicans for their reasoning for attempting to unseat Mayorkas reached the House Rules Committee record after they forwarded the impeachment resolution. In the 38-page letter, the three top lawyers claim that passing the impeachment resolution against Mayorkas would be unconstitutional. They further note that the attempt to impeach Mayorkas was a departure from the two centuries that had been spent on establishing an understanding of the Constitution’s impeachment clause, which had previously been correctly exercised. 

They continue by noting that apart from the fact that the impeachment articles do not have a basis in the Constitution they also mark a misrepresentation of the key statutes governing immigration law.

In the impeachment articles Mayorkas is accused of having violated immigration law and having failed to detain all of the migrants that have entered the U.S., this is a standard that has never previously been met. 

Mayorkas is also accused of a “breach of public trust” with many immigration law experts having shown skepticism over the allegations of the GOP, arguing that Mayorkas has followed the immigration policy of the Biden administration and is not in violation of any laws. 

In the letter, they further pointed out that Mayorkas in his leadership has always followed the law and that any allegation or suggestion that this was not the case was “false.”
