(TargetLiberty.org) – Rep. Chip Roy (R-Texas) announced on Friday that he plans to introduce a resolution urging Vice President Kamala Harris to convene the Cabinet and declare President Biden unable to fulfill his duties following Biden’s poor debate performance on Thursday.

This development comes in the wake of the CNN debate between Biden and former President Trump, where Biden stumbled over his words and appeared to lose his train of thought, raising concerns among Democrats.

“I intend to put forth a resolution calling upon the Vice President to immediately use her powers under Section 4 of the 25th Amendment to convene and mobilize the principal officers of the Cabinet to declare the President unable to successfully discharge the duties and powers of his office,” Roy wrote on the social platform X.

Speaking to reporters on Friday morning, Roy stated, “Anyone who watched last night objectively could see that President Biden is not capable of carrying out the duties of the commander-in-chief in a world facing increasing dangers.”

Roy emphasized that this concern is not politically motivated but is based on the president’s apparent declining capabilities. “For those of us who follow these issues closely, the president’s declining capacity has been evident, but last night made it clear to everyone. Our colleagues on the other side can no longer ignore it. This isn’t about political strategy; it’s about the president’s ability to do his job.”

Section 4 of the 25th Amendment, which has never been invoked, states that if the vice president and a majority of the Cabinet or Congress determine the president is “unable to discharge the powers and duties of his office,” the vice president should “immediately assume the powers and duties of the office as Acting President.”

The amendment reads: “Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.”

Vice President Harris defended Biden’s debate performance on CNN shortly after the event, acknowledging he had a “slow start” but argued he had a “strong finish” and presented a clear contrast to Trump.

“People can debate on style points, but ultimately, this election and who is the president of the United States has to be about substance. And the contrast is clear,” Harris told CNN’s Anderson Cooper. “During the debate, Donald Trump lied repeatedly, as he is known to do.”
