10 States Take Legal Action Over Vaccine Requirements

(TargetLiberty.org) – The Biden administration’s vaccine mandate is facing a new challenge after a group of states filed a lawsuit that argues it’s illegal. The states say the mandate threatens their healthcare systems, and they want it stopped.

On November 10, Attorneys General Eric Schmitt (MO) and Doug Peterson (NE) led the state AGs of Arkansas, Kansas, Iowa, Wyoming, Alaska, South Dakota, North Dakota and New Hampshire in filing suit against the administration over its order that all healthcare workers must be vaccinated against COVID-19. A press release from Schmitt warns that “last year’s healthcare heroes are turning into this year’s unemployed,” and says giving healthcare workers the choice of vaccination or termination is unconstitutional and illegal.

The lawsuit centers on the way the mandate overrides states’ powers, which the states argue violates multiple acts, the Tenth Amendment and the principle of federalism. The immediate problem, though, is that the mandate could force thousands of healthcare workers to quit their jobs – and that could leave millions of Medicare and Medicaid recipients, particularly in rural areas, without proper healthcare cover. The administration doesn’t seem concerned that health workers might stick to their guns and refuse vaccination, and that has states worried.
